The Customer's login provides access to the Services set out in Appendix 1 Services.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-67f7ea4 e-con-full e-flex e-con e-child\" data-id=\"67f7ea4\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;,&quot;animation&quot;:&quot;none&quot;}\">\n\t\t\t\t<div class=\"elementor-element elementor-element-86b818b elementor-widget elementor-widget-heading\" data-id=\"86b818b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">1.3 Use of FreightSolution<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-59d5fba elementor-widget elementor-widget-text-editor\" data-id=\"59d5fba\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Customer may only use FreightSolution for its own business purposes and may not give any third party access to the platform. The Customer is thus granted a non-exclusive, non-transferable right to use FreightSolution for the term of the agreement.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1ef612a elementor-widget elementor-widget-text-editor\" data-id=\"1ef612a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Customer ensures that the Users comply with this agreement and with the Supplier's user terms as they apply from time to time.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-59a2310 e-con-full e-flex e-con e-child\" data-id=\"59a2310\" data-element_type=\"container\" data-e-type=\"container\" class=\"elementor-element elementor-element-a4afe69 elementor-widget elementor-widget-text-editor\" data-id=\"a4afe69\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Supplier owns all rights to FreightSolution.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-f0bbd7a e-con-full e-flex e-con e-child\" data-id=\"f0bbd7a\" data-element_type=\"container\" data-e-type=\"container\" class=\"elementor-element elementor-element-c3c5e1f elementor-widget elementor-widget-text-editor\" data-id=\"c3c5e1f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Customer may purchase additional Services <\/span><span style=\"font-weight: 400;\">or other supplementary offerings, either<\/span><span style=\"font-weight: 400;\"> on a subscription basis or as a one-time payment.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-a5e65d4 e-flex e-con-boxed e-con e-child\" data-id=\"a5e65d4\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t<div confidentiality<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-1653786 e-con-full e-flex e-con e-child\" data-id=\"1653786\" Confidentiality<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7a423ff elementor-widget elementor-widget-text-editor\" data-id=\"7a423ff\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Using the Services on FreightSolution generates Shipment Data. Shipment Data is stored in FreightSolution and may be used for purposes such as Statistics. Shipment Data may contain personal data relating to the Customer's own customers.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f2fa43e elementor-widget elementor-widget-text-editor\" data-id=\"f2fa43e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Shipment Data and freight agreements are confidential. If the Customer wishes to enter into a separate confidentiality agreement, this can be arranged based on the Supplier's standard template.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-4c9d7e3 e-con-full e-flex e-con e-child\" data-id=\"4c9d7e3\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;,&quot;animation&quot;:&quot;none&quot;}\">\n\t\t\t\t<div class=\"elementor-element elementor-element-35d8ad5 elementor-widget elementor-widget-heading\" data-id=\"35d8ad5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2.2 Ownership and use of Shipment Data<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-75fa6fd elementor-widget elementor-widget-text-editor\" data-id=\"75fa6fd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">All Shipment Data and freight agreements are owned by the Customer. The Supplier may only use Shipment Data and freight agreements to deliver the services that the Supplier is obliged to provide under the Subscription Agreement.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1ea6a03 elementor-widget elementor-widget-text-editor\" data-id=\"1ea6a03\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Supplier is entitled to use anonymised Shipment Data for the development and improvement of FreightSolution, for statistics within the Services offered, and for internal and external business purposes, including reports, marketing and benchmarking. Before any such data is used, the Supplier must ensure that the Shipment Data is fully anonymised and contains no personal data.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-2ddd542 e-con-full e-flex e-con e-child\" data-id=\"2ddd542\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;,&quot;animation&quot;:&quot;none&quot;}\">\n\t\t\t\t<div class=\"elementor-element elementor-element-8e39617 elementor-widget elementor-widget-heading\" data-id=\"8e39617\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2.3 Processing of Shipping Data<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b7ff22c elementor-widget elementor-widget-text-editor\" data-id=\"b7ff22c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Customer is the data controller and the Supplier is the data processor. The Customer may therefore delete or anonymise Shipment Data itself at any time.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9effa92 elementor-widget elementor-widget-text-editor\" data-id=\"9effa92\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Supplier does not delete Shipment Data during the term of the agreement unless the Customer requests it. When the Subscription Agreement ends, the Supplier will delete all Shipment Data.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-107ed75 elementor-widget elementor-widget-text-editor\" data-id=\"107ed75\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Supplier ensures that Shipment Data is stored securely and is not lost.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-c4bf3d9 e-con-full e-flex e-con e-child\" data-id=\"c4bf3d9\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;,&quot;animation&quot;:&quot;none&quot;}\">\n\t\t\t\t<div class=\"elementor-element elementor-element-caea8f3 elementor-widget elementor-widget-heading\" data-id=\"caea8f3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2.4 Personal data security <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fe97a1f elementor-widget elementor-widget-text-editor\" data-id=\"fe97a1f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">In the event of a personal data breach, the Supplier is obliged to notify the Customer as soon as the Supplier becomes aware of the breach. It is the Customer's responsibility to notify any supervisory authority to the extent required.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-29997e0 elementor-widget elementor-widget-text-editor\" data-id=\"29997e0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The Supplier uses third-party technical sub-processors within the EU\/EEA.
